GENERAL TERMS & CONDITIONS

INCLUDED IN PRICE

Damage waiver. Unlimited kilometres. Breakdown assistance. All local taxes including GST. Free airport OR hotel pick up for rentals of more than seven days. Helmet and gloves if required. Big Boyz Toyz recommends using your own for safety and comfort. Luggage carriers and bags, security lock and friendly help and advice.

YOU MUST PRODUCE WHEN HIRING A MOTORCYCLE

Your current valid motorcycle licence - your credit card – Visa & MasterCard only accepted

OVERSEAS LICENCE HOLDERS MUST ALSO PRODUCE

Your passport - your motorcycle riders licence from your home country - your international motorcycle riders permit (if above licence is not in English) VERY IMPORTANT - Often many overseas banks automatically prevent large credit card transactions being processed as a way to safe guard against possible fraud. To minimise any hold up when collecting your motorcycle, please inform your credit card provider of your trip and that large amounts may be processed on occasions. If you have any questions about this - please contact us in advance for advice.

SECURITY DEPOSIT

Security bond amounts will vary depending on the bike you rent. The amount is listed against each bike on the price list. The deposit/bond is processed on a credit card and refunded upon safe return of the bike undamaged. Please note that we are not responsible for any exchange rate fluctuations or other fees your bank may charge when refunding the deposit/bond. Also note that some banks take a few days to put the funds back into your account. It is your bank that dictates the length of time this takes not the refunding bank.

PRICELIST TERMS EXPLAINED

Full Weekend = 4pm Friday to 10am Monday. Bond = security payment held until return of undamaged bike, must be paid by RENTER'S credit card. Excess = non-reducible damage waiver deductible. See Damage waiver below.

DAMAGE WAIVER

Breach of rental contract terms voids THE Damage Waiver and the renter is liable for ALL damage. You also have the option for AU$20 per day (for rentals over 7 days) to reduce the damage waiver excess amount as shown above to 50% of the standard excess amount. Damage waiver DOES NOT cover - rider for bodily injury or damage/loss of personal belongings. Supplementary travel insurance is advised. - loss of rental caused by extensive damage to the motorcycle rendering it unavailable for hire. Damage Waiver includes: damage to and/or theft of motorcycle; third party injury; and third party property. Renter is liable for excess amount.

CANCELLATIONS

In the event of a cancellation the following fees apply... - Over 21 days prior to the start date - 20% of the total fee - 7-20 days prior to the start date - 50% of the total fee - 2-6 days prior to the start date - 80% of the total fee - 48 hours or less - 100% of the total fee

ONE WAY AND EXTENDED RENTALS

You can drop off your motorcycle at any city and simply pay the freight costs of shipping the bike back to the depot. One way fees are typically around AU$495 (15 day minimum rental) assuming 90 days notice. Please ask for costs if your planned dates are less than 90 days away. If you are hiring a bike for a long period and expect to travel a long way then you must agree to have the bike serviced somewhere along the way. We will help you plan and arrange for this. In addition we will replace tyres that are fully worn (we will agree upfront with you on the life of the tyre before you leave our depot) and provided you contact us before replacing the tyres and you can provide us with receipts and documentation from the tyre provider.

NOT INCLUDED IN OUR PRICES

Parking tickets, speeding fines and other penalties. A $50 fee may be imposed for the handling of unpaid fines. Fuel (except on guided tours). A $30 charge applies to motorcycles returned without a full tank. Car parking. Road tolls - please review important toll information {need this linked to the Toll info below}

PERSONAL TRAVEL INSURANCE

It is vital that you have appropriate travel insurance, which offers cover while motorcycling. Big Boyz Toyz, its Agents, Assigns and Contractors accept no responsibility for a customer's failure to arrange appropriate cover. Please also note that cover is often void if a helmet is not being worn. We strongly recommend you cover yourself with travel insurance in case of accident and to ensure that if your personal circumstances change and you have to cancel your costs are covered.

HELMETS

It is a condition that you wear an approved crash helmet at all times when riding your motorcycle. Big Boyz Toyz strongly encourages you to bring your own helmet for comfort reasons, however we do supply compliant helmets should you choose not to bring your own.

MECHANCIAL DIFFICULTIES / ACCIDENT

In the event of mechanical breakdown or accident, report this to the emergency number issued to you by the depot. Do not undertake repairs without the prior agreement of the depot. In the event of an accident (or theft), always report it to the police immediately, obtain a police report number, and notify the depot. The depot will make every effort to provide repair facilities or a replacement motorcycle, but is not obliged to do so. Where a motorcycle has been crashed and is not able to be ridden any further, Bib Boyz Toyz, its Agents, Assigns and Contractors are under no obligation to replace or supply another motorcycle for the completion of the journey and no compensation can be claimed by the hirer for the unused portion of the hire period.

OUTBACK TRAVEL

Outback travel on remote gravel roads can be extremely dangerous unless you are well prepared and know how to deal with difficult situations. Every year tourists find themselves in trouble and some even die due to lack of preparation and knowledge. If you intend to ride on remote gravel roads then you MUST inform us of your plans. Big Boyz Toyz forbid their bikes to be ridden on the following roads; Savannah Way, Plenty Highway, Great Central Road, Gunbarrel Highway, Gibb River Road, Tanami Track, Oodnadatta Highway, Birdsville Track, Canning Stock Route and any Cape York track without written permission from us. This list is not exclusive - if you have any questions please consult us for clarification. Should your bike break down for ANY reason on unsealed roads then you will be responsible for all recovery costs. Motorcycle Damage Waiver does not cover this travel and/or any damage to the motorcycle or other vehicles. Please request authority before taking bikes on unsealed roads. This is for your own protection as unnecessary deaths happen every year.

INDEMNITY RELEASE

By booking a rental, self guided tour or guided tour you agree that you understand and agree to the indemnity release detailed below which is between you (and any passengers) and Keychoice Holdings Pty Ltd T/A Big Boyz Toyz Hire, it's directors, employees or agents (hereafter called The Company). You must agree that you shall participate entirely at your own risk and that you, your successors, executors and administrators will release, indemnify and not instigate any claim, demand or expense against The Company for any personal injury, loss of life or damage to personal property suffered during or subsequent to events on the rental or tour. You must acknowledge that any road whether sealed or unsealed, or any other venue upon which you travel, may have sandy or rocky surfaces with defects either hidden or exposed as is the nature of some roads. You must agree to obey and observe all rules and directions given during a tour, whether given in writing or verbally by The Company and that The Company has the right to exclude you from any tour for non-adherence to any rule or direction given. You must accept that you are permitted to rent a motorcycle or take part in a tour on condition that you ride safely with due care and regard for other people and property. You must acknowledge that motorcycle riding, whether as a rider or passenger, can be dangerous and that a motorcycle rental or participation in a tour organised and promoted by The Company may expose you to the possibility of injury or death and further, you must acknowledge that the way other people may ride, drive or act is outside the control of The Company. You must acknowledge that there may be no, or inadequate facilities for treatment or transport of participants if participants are injured. You agree that you understand that travel insurance to cover all forms of personal injury, repatriation or costs in the event of death is essential and it is your responsibility to ensure you have appropriate cover. You agree to wear appropriate motorcycle safety equipment at all times and that you are medically fit to undertake a motorcycle rental or tour. You must agree that you have read and understood the indemnity release and agree that the motorcycle rental or participation in a tour whether guided or self guided is entirely at your own risk.

IMPORTANT NOTICE

Toll Information On a rental bike you are responsible for paying tolls on motorways. If you expect to travel on cashless tollways in NSW/VIC/QLD, we suggest that you acquire an e-Pass tag though the RTA website. This pass can be purchased for a period of up to 14 days per booking (within 48 hours of passing through the toll point). Alternatively, you can contact the appropriate toll operator on the relevant phone number listed at the Toll point within 48 hours of passing the toll point. If Big Boyz Toyz receives any unpaid toll notices incurred within the contract period, for the bike hired by you, then as per our Terms and Conditions we will charge your credit card with the toll fee, any listed administration fees and a Big Boyz Toyz administration fee of $20 per notice. We will forward a copy of the payment receipt to any email address provided by you. RTA web address; www.myrta.com.au. Select the link My E Toll link and then select; Register for an e-toll pass tag. You will need your credit card and will be asked for the motorcycles registration number and state – this information is available on the Rental Agreement you where given at the time of collecting the bike.

1 ACCEPTANCE OF TERMS

Your access to and use of this website is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.

6 DISCLAIMERS AND LIMITATION OF LIABILITY

6.1 The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

6.2 To the extent permitted by law, Big Boyz Toyz will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

6.3 Big Boyz Toyz makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

7 INDEMNITY

You agree to indemnify and hold Big Boyz Toyz and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Big Boyz Toyz arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

8 SEVERANCE

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
